Eligibility: The Torrid New Moon Ultimate Fan Giveaway (“Sweepstakes”) is open to legal residents of the 50 United States or the District of Columbia (excluding Rhode Island and U.S. possessions and territories) who are eighteen (18) years of age or older (or of legal age of majority in their state of residence, whichever is older) as of 10/21/09, except employees, officers, directors, agents and shareholders of Hot Topic, Inc. d/b/a Torrid (“Sponsor”), Summit Entertainment, LLC (“Summit”) and each of their respective parent companies, affiliates, distributors, subsidiaries, and advertising/promotion agencies (collectively, “Released Parties”) and their immediate families (spouses, parents, children, and siblings and their respective spouses, regardless of where they reside) and those living in the same household, whether or not related. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Summit is not responsible for the administration of the Sweepstakes, the collection of entries, or the selection of winners.
Promotion Period: Sweepstakes begins at 12:00:01AM Eastern Time (“ET”) on 10/23/09 and ends at 11:59:59PM ET on 11/15/09 (“Promotion Period”). For the purposes of this Sweepstakes, a day is defined as the 24-hour period beginning at 12:00:01AM ET and ending at 11:59:59PM ET. Sweepstakes consists of a random draw Grand Prize Sweepstakes and 27 Daily Prize Sweepstakes. Each Daily Prize Sweepstakes is independent of the others and will include only those entrants who submit an entry that day (each, a “Daily Entry Period”).
GRAND PRIZE SWEEPSTAKES. Three ways to enter: 1) New Moon Purchase: Automatically receive (1) Grand Prize Sweepstakes entry when you make a qualifying New Moon merchandise purchase at participating Torrid store locations or online at Torrid.com during the Promotion Period. For the Torrid store location nearest you, visit www.Torrid.com during the Promotion Period. Account adjustment transaction, returns, and international transactions are not eligible transactions for entry. Entries from unauthorized credit cards or card numbers or made with lost, stolen, or fraudulent credit cards or card numbers are void. 2) Mailed Entry: To enter the Grand Prize Sweepstakes offline without making a purchase and receive one (1) entry, hand print your full name, complete mailing address, telephone number (area code included), and date of birth on a plain 3”x 5” piece of paper and mail it in a sealed, properly stamped and hand printed #10 envelope to: Torrid New Moon Ultimate Fan Giveaway, 18305 East San Jose Avenue, City of Industry, CA 91748. Each entry must be mailed separately, postmarked by 11/15/09 and received no later than 11/22/09. 3) Online Entry (includes Daily Prize Sweepstakes entry, see below): To enter the Grand Prize Sweepstakes online without making a purchase and receive one (1) entry, visit Torrid.com and fully complete/submit registration per the directions provided during the Promotion Period to receive (1) Grand Prize entry. All entries become property of the Sponsor and will not be returned. No photocopied, computer generated facsimiles, mechanically reproduced, or mass entries are permitted and all such entries will be void. Entries generated by script, macro or other automated means and entries by any means which subvert the entry process will be void. Limit one (1) Grand Prize Sweepstakes entry per person and/or per email address per day, regardless of entry method used. Attempts to enter more than once per day will result in disqualification of all entries from that person/email address.
27 DAILY PRIZE DRAWINGS. Entrants who enter the Grand Prize Sweepstakes online (see above) will also receive one (1) Daily Prize Drawing entry, good for that Daily Entry Period’s drawing only. Limit one (1) Daily Prize entry per Daily Entry Period per person/email address. Attempts to enter more than once per day will result in disqualification of all entries from that person/email address.
Released Parties are not responsible for lost, incomplete, illegible, late, garbled, inaccurate, misdirected, stolen, undelivered, delayed, damaged, postage-due, Sweepstakes Data, transactions, entries, or mail; any error, omission, interruption in service due to system upgrades, repairs, modifications or other causes, defects/delays in transmission or communication, 3rd party transaction classification, transaction processing, or communication; telephonic, human, network, mechanical, computer, electronic or other problems or errors; theft, destruction or unauthorized access to, or alteration of, Sweepstakes Data; technical or mechanical malfunctions; failures or malfunctions of phones, phone lines, telephone systems, interrupted or unavailable network, server, cable, satellite, Internet Service Provider (ISP) or other connections, miscommunications or technical failures, programming, human error or otherwise, relating to/in connection with Sweepstakes, including, without limitation, errors that may occur in connection with Sweepstakes administration, Sweepstakes Data processing, the processing of entries or Pins or prize announcements; Internet traffic congestion or any technical problem, including, without limitation, any injury or damage to any person’s computer related to/resulting from Sweepstakes participation; errors or omissions in these Official Rules, in any Sweepstakes-related ads or other Sweepstakes-related materials; human-processing error; electronic equipment, computer hardware or software failures; or inaccurate entry information, whether caused by equipment, Sweepstakes programming, human error, or otherwise. Sponsor reserves the right to void Sweepstakes Data and entries of an entrant who Sponsor believes has attempted to tamper with/impair Sweepstakes administration, security, fairness, or proper play.
Winner Selection: Potential Grand Prize winner will be selected in a random drawing on/about 11/23/09 from among all eligible entries received as described above during entire Promotion Period. Potential Daily Prize winners will be selected in a total of twenty-seven (27) individual random Daily Prize drawings (one (1) drawing for each Daily Entry Period) on/about 11/23/09 from among all eligible entries received during each applicable Daily Entry Period as outlined above. Potential winners will be notified by email, telephone and/or mail. Odds of winning any prize will depend on the number of eligible entries received for the applicable drawing. Non-winning entries from one Daily Entry Period drawing will not carry over into any other Daily Entry Period drawing. Limit one (1) Daily Prize per person, per email address, per immediate family member, and per household.
Prize: (1) Grand Prize is available. The Grand Prize consists of: Two round trip airline tickets from the major United States airport nearest the winner's residence to the major airport nearest Forks, Washington, two movie tickets and hotel accommodations for three (3) days and two (2) nights (standard room, double occupancy) in a hotel to be determined (at the sole discretion of the Sponsor) (Approximate Retail Value “ARV” = $2,000). Taxes, and all other expenses not specified and related to the acceptance and use of the Grand Prize are winner’s sole responsibility. All prize details not specifically set forth herein are at Sponsor’s sole discretion. Actual value of travel prize will depend on airfare from winner’s location, and any difference in actual and estimated value will not be awarded. Sponsor reserves the right in its sole discretion to substitute ground transportation for airline transportation if that would be more expedient or logical given winner’s location. (27) Daily Prizes (one (1) per day): Each daily prize is two Movie Tickets (ARV = $10 each ticket). Ticket restrictions may apply, as specified by issuer. Daily Prizes to be fulfilled via email or U.S. mail within approximately (10) weeks following end of the Promotion Period. Total ARV of all Prizes=$2,540. Tickets are subject to certain terms and conditions specified by Torrid. Federal, state, and local taxes and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are winners’ sole responsibility. All prize details are at Sponsor’s sole discretion.
Miscellaneous: All entrants understand that traveling involves certain risks of death, injury or property damage; if winner, entrant assumes all such risks. No transfer, assignment, cash redemption or substitution of prizes except by Sponsor at its sole discretion, which reserves the right to substitute a prize with one of comparable or greater value. Potential Grand Prize winner and travel companion will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within (5) days of date of issuance of notification. Travel companion must be adult (age 18 or older or age of majority or older) or winner’s spouse or child who is age-appropriate for the movie and must possess all required travel documents. Non-compliance with any of the foregoing or the inability to contact the potential Grand Prize winner within a reasonable time period may result in disqualification and, at Sponsor’s sole discretion, awarding of prize to an alternate winner. If any prize notification letter or prize is returned as undeliverable, or if any potential winner is not in compliance with these Official Rules, such winner will be disqualified and an alternate winner may be selected for the drawing at issue, at Sponsor’s sole discretion.
By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor and judges, which are final and binding, and agree that: 1.) Released Parties and their respective designees and assigns shall have the right and permission to use (unless prohibited by law) the entrant and travel companion’s names, voices, cities/states of residence, photographs, and/or likenesses for advertising and/or trade and/or any other purpose in any media or format now or hereafter known worldwide in perpetuity without further compensation, permission, or notification; and 2.) Released Parties and their respective designees and assigns shall have no liability and will be held harmless for any claim, liability, loss, injury or death to entrant or any other person, including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to disqualify any entry and to modify, terminate or suspend this Sweepstakes (or portion thereof) should virus, bugs, non-authorized human intervention, action of entrants, or other causes corrupt or impair the administration, security, fairness or proper play of the Sweepstakes and, if the Sweepstakes (or portion thereof) is terminated, at Sponsor’s discretion, to select the winner(s) for the drawing(s) at issue from those eligible, non-suspect entries received for the applicable drawing(s) prior to event requiring such termination.
Online registration. This sweepstakes is intended for viewing in the United States only and shall be construed and evaluated only according to United States law. Do not enter this sweepstakes online if you are not located in the United States. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY COMPUTERIZED SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Online entries will be deemed made by the authorized account holder or user of the email address submitted at the time of entry. In the event of a dispute, the potential winner may be required to provide proof that he or she is the authorized account holder or user of the identified email account, and Sponsor’s decision will be final. “Authorized account holder or user” is defined as the natural person who is assigned to an email address by an Internet access provider or has permission of the assignee to use the account.
